Moodz Terms of Service

Summary: Moodz is a mood tracking app that stores all data locally on your device. We don't collect your personal data. Subscriptions are managed through RevenueCat and processed via the App Store or Google Play. By using Moodz, you agree to these terms.

1. Overview of the Service

Welcome to Moodz ("the Service"). Moodz is a character-driven emotional wellness brand developed and operated by Charlotte Stephens, trading as Moodz ("we", "us", "our"). The Service consists of:

The app lets you record your daily emotions, track lifestyle factors, view mood insights, and engage with gamification features such as streaks, coins, levels, and unlockable themes and hoodies.

The UK Mood Map is a public, anonymous, daily aggregate view of how the UK is feeling, region by region. The Moodz Wall is a public, moderated board of one-line mood notes from anyone who wants to share.

Important: The Moodz app stores all your personal data (mood entries, journal notes, and tracking data) locally on your device. We do not collect, transmit, or store your in-app personal mood data on any external servers. The Mood Map and Wall are separate website-only features — see our Privacy Policy for what we store for each.

2. Eligibility

You must be at least 13 years of age to use Moodz. If you are between 13 and 18 years old, you must have consent from a parent or legal guardian to use the App. By using Moodz, you represent and warrant that you meet these eligibility requirements.

3. Account and Security

Moodz does not require you to create an account or provide any personal information to use the App. If you set up a PIN or biometric lock within the App, you are responsible for keeping your access credentials secure. We cannot recover your PIN if you forget it, as we do not have access to this information.

4. Subscriptions and Payments

4.1 Free and Pro Tiers

Moodz offers a free tier with limited features and a Pro subscription that unlocks the full experience, including unlimited mood history, custom tracking factors, detailed insights, therapist export reports, and bonus Moodz coins.

4.2 Pricing

Prices are displayed in your local currency and may vary by region. All prices are inclusive of applicable taxes unless otherwise stated.

4.3 Payment Processing

All payments are processed through the Apple App Store or Google Play Store, depending on your device. Subscription status is managed by RevenueCat, a third-party subscription management platform. RevenueCat processes an anonymous device identifier to verify your subscription entitlements. We do not directly collect or process any payment information. Your purchase is subject to the terms and policies of the respective app store.

4.4 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription through your device's app store settings.

4.5 Free Trials

We may offer free trial periods from time to time. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the applicable rate.

4.6 Refunds

Refund requests are handled by Apple or Google, as applicable, in accordance with their respective refund policies. We do not process refunds directly.

5. Your Data and Privacy

5.1 Local Data Storage

All mood entries, journal notes, tracking factors, streaks, coins, levels, themes, and preferences are stored locally on your device. We have no access to this data and cannot view, retrieve, or recover it.

5.2 Analytics

We use TelemetryDeck, a privacy-focused analytics service, to collect anonymous, aggregated usage data such as which screens are visited, app performance metrics, and general usage patterns. This data contains no personally identifiable information and cannot be traced back to you. No cookie consent or opt-in is required as no personal data is processed.

5.3 Subscription Data

Subscription status is managed through RevenueCat, a third-party subscription management platform. RevenueCat processes an anonymous user identifier to manage your subscription entitlements. It does not have access to your mood data, journal entries, or any other personal content within the App.

5.4 Fonts and External Resources

All fonts used within the Moodz app are bundled locally. The app does not load fonts or other resources from third-party servers, ensuring no external requests are made that could track your usage.

5.5 No Data Sale

We do not sell, share, or distribute any user data to third parties. Full details of our data practices can be found in our separate Privacy Policy.

6. Intellectual Property

All content within Moodz, including but not limited to the mood characters, illustrations, animations, themes, interface design, branding, text, and software code, is owned by Charlotte Stephens, trading as Moodz and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or create derivative works based on any part of the App or its content without our prior written consent.

The Moodz name, logo, and character designs are trademarks of Charlotte Stephens, trading as Moodz. Unauthorised use is prohibited.

8. Moodz Wall — Submissions and Moderation

8.1 What the Wall is

The Moodz Wall at moodz.xyz/wall/ is a public, moderated board where anyone can submit a one-line note about how they're feeling. You choose a mood, write up to 80 characters, and can optionally add a first name and a city. Submissions are reviewed by a human moderator before they appear on the public wall.

8.2 You're responsible for what you submit

You retain full authorship and ownership of the words you write. By submitting a note, you grant Moodz a non-exclusive, royalty-free, worldwide licence to display that note on the public wall and in the wall archive, for as long as we operate the Wall or until you ask us to remove it. We will not edit your note other than to reject obviously inappropriate content; if we feel a note needs an edit to be publishable, we'll reject it rather than change your words.

You must not submit content that breaches section 7. We reserve the right to reject any submission that does, and to remove any approved submission later if we receive a report or otherwise become aware of an issue.

8.3 No personal information about others

Do not include other people's names, addresses, phone numbers, social media handles, or any other identifying information without their explicit consent. Moderators will reject any submission that appears to identify a third party.

8.4 Right to remove your own note

You can ask us to remove your submission at any time by emailing contact@moodz.xyz with enough detail for us to find it (the mood, the date, your name or city if you included one). We aim to remove within 7 days from both the live wall and the archive.

8.5 Crisis and safety

The Wall is not a crisis service. If you're in distress, please use the resources listed at moodz.xyz/safety or contact your local emergency services. Submissions that contain words associated with self-harm or crisis may be flagged for priority human review; this is a safety measure, not a substitute for professional help.

9. Health and Wellbeing Disclaimer

Moodz is not a medical device, therapeutic tool, or substitute for professional healthcare. The mood tracking, insights, breathing exercises, Mood Map, and Moodz Wall are intended for general wellbeing and self-awareness purposes only.

You should not rely on Moodz for the diagnosis, treatment, or management of any mental health condition. If you are experiencing mental health difficulties, please consult a qualified healthcare professional. If you are in crisis, contact your local emergency services or a crisis helpline immediately.

The therapist export feature is provided as a convenience to help facilitate conversations with your healthcare provider. It does not constitute a clinical report or medical record.

10. Virtual Currency and Gamification

Moodz coins, streaks, levels, badges, and unlockable themes and hoodies are virtual items with no real-world monetary value. They cannot be exchanged, transferred, refunded, or redeemed for cash or any other consideration. We reserve the right to modify the virtual economy, including coin earning rates, level thresholds, and item availability, at any time.

12. Disclaimers and Limitation of Liability

12.1 "As Is" Provision

Moodz is provided on an "as is" and "as available" basis. We make no warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

12.2 No Guarantee of Availability

We do not guarantee that the Service will be available at all times, free from errors, or uninterrupted. We may update, modify, or discontinue features at our discretion. The Moodz Wall may be paused for moderation or maintenance.

12.3 Data Loss

Because your app data is stored locally on your device, we are not responsible for any data loss resulting from device failure, damage, loss, theft, factory reset, app deletion, or operating system updates. We strongly recommend keeping your device backed up. For website features (Mood Map, Wall), we keep backups in line with industry standard practice but do not guarantee any particular recovery point in the event of catastrophic loss.

12.4 Limitation of Liability

To the maximum extent permitted by applicable law, Charlotte Stephens, trading as Moodz and her directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to loss of data, loss of profits, or emotional distress.

Our total aggregate liability to you for any claims arising from or related to these Terms or the App shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Charlotte Stephens, trading as Moodz, her officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party — including, on the Moodz Wall, any submission of yours that breaches section 7 or 8.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App or by other appropriate means. Your continued use of Moodz after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

15. Termination

You may stop using Moodz at any time by deleting the App from your device. We reserve the right to suspend or terminate your access to Pro features, the Mood Map, or the Wall if we reasonably believe you have violated these Terms.

Upon termination, your right to use the Service ceases. Any data stored locally on your device remains under your control unless you delete the App. Active subscriptions should be cancelled through your app store settings to avoid further charges.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Nothing in these Terms affects your statutory rights as a consumer under applicable UK consumer protection laws, including the Consumer Rights Act 2015.

17. General Provisions

17.1 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Charlotte Stephens, trading as Moodz regarding your use of the Service.

17.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

17.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
